What does French law require?
If you send a worker to France under a contract with a French client, you fall under Directive 96/71/EC and Loi Macron (decree 2016-418). Non-compliance results in fines from €2,000 to €4,000 per worker, up to €500,000 in total.
- SIPSI declaration (or equivalent) before the mission starts
- Translation of the employment contract into French and keeping a copy on site / in the vehicle
- Pay compliant with the collective agreement of the French client's sector
- A1 certificate for every posted worker
- Designation of a representative in France (Loi Macron)
- Document archiving up to 18 months after the mission

Frequently asked questions about inter-company posting
The obligation arises from the first day of the mission. The SIPSI declaration must be filed before work starts. Even a one-day service trip to a French client is subject to the same rules as a multi-week project.
Yes, but it's a different legal situation (B2B contract, no posting) and usually more expensive. Posting a Polish employee with a Polish employment contract is fully legal — provided the formalities are met.
Yes. If the French collective agreement of the client's sector provides a higher minimum than the Polish one, you must pay the difference. We identify the right agreement and calculate the supplement (if any).
